The Challenge: At your average financial office, clients have their own physical file with important information. Client information is often stored in many different systems and locations. Furthermore, large fines have been imposed for not following regulations such as the FRCP Amendment and SEC rule 17a-4, which applies to email management within broker-dealer organizations. For example, SEC Rule 17a states that broker-dealers must preserve all electronic records "exclusively in a nonrewritable, non-erasable format." (It almost goes without saying that these and all other corporate records, be retained only as long as legally required, after which time they are destroyed.) The rule also requires, however, that broker-dealers be able to produce those records in a timely manner in the event of an audit or regulatory investigation. This combination of requirements places enormous demands on a financial institution that can only be met with specific technologies.

Also the FRCP Amendment is a new set of rules which require U.S. companies to keep better track of their employees' e-mails, instant messages and other electronic documents in the event the companies are sued, legal experts say. They are part of amendments to federal rules governing civil litigation and were approved by the Supreme Court's administrative arm in April after a five-year review.
